Shoplifter Sues Store Owner After Being Shot In The Face

A shoplifter who was chased down and shot in the face after stealing a bottle of vodka from a Colorado Springs liquor store is now suing the owner of that store for pain and suffering.

Bryson Adrian Dewberry, 24, was shot in the jaw two years ago during a failed attempt to steal an expensive bottle of Grey Goose vodka. Dewberry's accomplice, who was 17-years-old at the time, suffered a gunshot wound to the leg. Both men were taken to the hospital with serious but non life-threatening injuries.

According to police, the owner of Austin Bluffs Plaza Liquor, Chang Ho Yi, now 59, chased the two young men to their car and fired one shot at close range with a .357 revolver, injuring both of the young men.

Yi was later arrested for attempted first degree murder but a grand jury declined to charge him.

Colorado law allows residents to use deadly force against a trespasser if they feel endangered. The same rule does not apply however when the shooter is outside of their property.

Dewberry is now seeking $100,000 for pain and suffering. According to the lawsuit, Dewberry -- who wasn't charged in the incident -- is "disfigured" and has required ongoing speech therapy.
